I. TERMS OF USE

In order to access and use the services on the [INSERT DOMAIN NAME] website [INSERT TÊN MIỀN] (hereinafter referred to as “HI GIO CLOUD powered by FPT & IIJ”), users must agree to and comply with the terms set forth in this Agreement.
When accessing and using HI GIO CLOUD powered by FPT & IIJ through any means (computer, phone, television, or other internet-connected devices), users are also required to adhere to this Agreement.
To comply with legal regulations, the terms stipulated in this Agreement may be updated or modified at any time without prior notice to users. FPT will clearly announce any such changes and additions on the website and forums.

II. REGISTER ACCOUNT AND USE

• 1. When considering the use of HI GIO CLOUD powered by FPT & IIJ, the User commits to the following:
  a. Being of legal age to establish a legally binding Agreement and not being prohibited by the current laws from using HI GIO CLOUD powered by FPT & IIJ, or
  b. Having prior approval from the User’s legal parents or guardians to use HI GIO CLOUD powered by FPT & IIJ in accordance with the provisions and in compliance with the Agreement
• 2. At the same time, when registering an account and using HI GIO CLOUD powered by FPT & IIJ, the User also agrees to the following terms:
  Users may change their account name, but the name must be set in compliance with FPT’s regulations and must not violate any prohibitions in this Agreement.
  Adherence to the regulations and policies at the address www.higio.net/Terms of Use. In the event that the User violates the provisions at this address and/or this Agreement, the User will be subject to penalties as specified in the Cloud Computing Infrastructure Service Contract or the Terms and Conditions of Use of HI GIO CLOUD powered by FPT & IIJ, depending on FTI’s decision.
  Some features of HI GIO CLOUD powered by FPT & IIJ require Users to register and log in to use. If Users do not register or log in, they can only use normal features. We encourage Users to register an account to fully utilize the features of the HI GIO CLOUD powered by FPT & IIJ system.
  Links to other websites or icons of other websites may appear on the HI GIO CLOUD powered by FPT & IIJ website. These websites are not under the control or ownership of FPT. Accessing these other websites can carry risks and dangers. Users are solely responsible for any risks that may arise when using these linked websites. FPT will not be responsible for the content of any websites or destinations other than the HI GIO CLOUD powered by FPT & IIJ website.

III. PROHIBITED ACTIONS WHEN USING THE HI GIO CLOUD POWERED BY FPT & IIJ WEBSITE

When using HI GIO CLOUD powered by FPT & IIJ, the User is not allowed to engage in the following actions:

• 1 Exploiting HI GIO CLOUD powered by FPT & IIJ to collect information from other Users.
• 2. Naming the User account after celebrities, leaders of the Party and the Country, individuals, criminal organizations, subversive groups, terrorists, or accounts with inappropriate or offensive connotations, contrary to cultural norms.
• 3. Promoting any products in any form is strictly prohibited, including but not limited to sending or transmitting any messages of an advertising nature, invitations, chain letters, investment opportunities, and so forth.
• 4. Interfering with the law, causing disruption, or sabotaging the server system is strictly prohibited. This includes obstructing access to information and the use of lawful websites on HI GIO CLOUD powered by FPT & IIJ.
• 5. Illegally using passwords, encryption keys of organizations, individuals, personal information, private information, and internet resources is strictly prohibited.
• 6. Directly or indirectly using any devices, software, internet websites, or other means to remove, alter, bypass, evade, obstruct, or damage any copyrights, trademarks, or other ownership rights marked on the Content (such as logos) or any data control systems, devices, content protection measures, as well as access restrictions from different geographical regions is strictly prohibited.
• 7. Directly or indirectly, through any device, software, internet website, or other means, copying, downloading, capturing, reproducing, duplicating, storing, distributing, uploading, publishing, modifying, translating, broadcasting, presenting, displaying, selling, transmitting, or retransmitting content is strictly prohibited.
• 8. Creating, reproducing, distributing, or advertising any part of the content without the consent of FPT is not allowed. Users are not permitted to establish a business model using the content, whether for profit or not. The content mentioned on the website www.higio.net includes, but is not limited to, any text, graphics, images, layouts, interfaces, icons, images, audio and video materials, and static images. Additionally, we strictly prohibit the creation of derivative products or materials from or based on any content, including making films, creating similar videos, wallpapers, computer themes, greeting cards, and merchandise.
• 9. Impersonating organizations or individuals and disseminating false or misleading information on the [INSERT DOMAIN NAME] website [INSERT TÊN MIỀN] that infringes upon the legitimate rights and interests of organizations and individuals is strictly prohibited.
• 10. Creating links to illegal domains of organizations or individuals. Creating, installing, distributing malicious software or computer viruses, unauthorized intrusion, taking control of information systems, and establishing internet attack tools.
• 11. Absolutely refrain from using any programs, tools, or other means to interfere with the HI GIO CLOUD powered by FPT & IIJ system.
• 12. There must not be any actions aimed at unauthorized login or attempts to gain unauthorized access or cause damage to FPT’s server system.

Users are personally responsible under the law for any actions they undertake.

IV. LIMITATION OF LIABILITY

• 1. In the force majeure event of risks or damages, including but not limited to power outages, hardware or software failures, internet connection disruptions, or natural disasters, the User must accept any risks or damages that may occur. FPT commits to making efforts to minimize such risks and damages; however, FPT will not bear any responsibility arising from these circumstances.
• 2. FPT’s legal liability for any User’s damages shall not exceed the amount received by FPT from the User when using HI GIO CLOUD powered by FPT & IIJ.

IV. LIMITATION OF LIABILITY

• 1. In the force majeure event of risks or damages, including but not limited to power outages, hardware or software failures, internet connection disruptions, or natural disasters, the User must accept any risks or damages that may occur. FPT commits to making efforts to minimize such risks and damages; however, FPT will not bear any responsibility arising from these circumstances.
• 2. FPT’s legal liability for any User’s damages shall not exceed the amount received by FPT from the User when using HI GIO CLOUD powered by FPT & IIJ.

To the maximum extent permitted by law, the User agrees to indemnify, defend, and hold harmless FPT, its subsidiaries, and its directors, representatives, officers, employees, and agents from and against any and all claims, actions, lawsuits, or legal proceedings, as well as any and all damages, liabilities, losses, and expenses (including legal fees) arising from or related to the User’s use of HI GIO CLOUD powered by FPT & IIJ or any User’s violation of the Agreement.

VII. RIGHTS AND OBLIGATIONS OF FPT

• 1. FPT Rights:
  Provide User information when requested by competent state authorities.
  Apply the sanctions stipulated in the Agreement.
• 2. FPT Obligations
  Have the responsibility to assist account holders during the use of HI GIO CLOUD powered by FPT & IIJ.
  Have the responsibility to ensure the confidentiality of User’s private information, notify Users of their rights, responsibilities, and risks when storing, exchanging, and sharing information on the network.
  Ensure the User’s decision-making rights when allowing their personal information to be provided to other organizations, businesses, or individuals.
  Receive and resolve customer complaints in cases that arise during the use of HI GIO CLOUD powered by FPT & IIJ. However, we only provide support, receive, and resolve complaints for accounts that are registered with complete, truthful, and accurate information.

VIII. DATA COLLECTION

• 1. Personal Identification Information
  During the use of HI GIO CLOUD powered by FPT & IIJ, we may request Users to provide some personal identification information for communication or user identification (“Personal Information”). Personal Information may include, but is not limited to, the User’s name, country of residence, email address, and website address.
• 2. Non-personal identification information
  When Users use HI GIO CLOUD powered by FPT & IIJ (whether on a computer, phone, TV, internet-connected device, on the Website, or on the website of one of our partners or other third parties), we collect information related to Users’ use of websites and information that our browser sends whenever Users access a website or online service, including, but not limited to, the User’s computer’s Internet Protocol (IP) address, browser type, the web page visited before coming to our site, and any search information Users enter.
  When Users use a widget or any other tool offered by FPT, whether on the computer, laptop, telephone, Internet TV, on the Site or on a third party website, including a website owned or operated by Users, FPT may record data related to that activity, the deployment of the widget or tool and any other account related data.

IX. SECURITY

We are committed to protecting User information. We use security measures designed to protect User information from unauthorized access and disclosure. However, we cannot guarantee that User’s personal information or private communications will always remain private and secure.

INTERNATIONAL PROCESS OR TRANSFER

User information may be processed or transferred outside of Vietnam, where data protection laws may not be as protective as data protection laws in Vietnam.

XI. DISCLOSURE

We have the right to disclose any information obtained by us, including but not limited to Personal Identifiable Information and Non-Personally Identifiable Information, (i) as required by law or by government authorities; or (ii) in emergency situations; or (iii) to successor entities in connection with mergers, acquisitions, bankruptcies, or substantial asset sales.

XII. GENERAL TERMS

FPT reserves the right to modify the website without prior notice, including but not limited to fees for accessing and/or using HI GIO CLOUD powered by FPT & IIJ. FPT also reserves the right to terminate any or part of the HI GIO CLOUD powered by FPT & IIJ application at any time without prior notice.
FPT’s failure to exercise or enforce any rights or provisions in this Agreement shall not be deemed a waiver of those rights or provisions, and they shall remain valid and enforceable by FPT.
The terms of this Agreement are independent and separate from each other. If any provision is invalid or unenforceable for any reason, that provision shall be adjusted as necessary to be valid and enforceable, or if it cannot be adjusted, it shall be removed, and the remaining terms of the Agreement shall remain in full force and effect when this Agreement is executed with the invalid or unenforceable provisions removed.
The User waives the right to bring any action arising between the two Parties. This Agreement and the User’s relationship with FPT under this Agreement shall be governed by the laws of the Socialist Republic of Vietnam without regard to its conflict of law provisions. The User and FPT agree to select the Vietnam International Arbitration Center (VIAC), pursuant to its Rules of Arbitration, to settle any legal issues arising from this Agreement.
This Agreement is binding on the User from the moment the User agrees during the account registration process.
